Terms & Conditions

JP Photography is the owner or licensee of all intellectual property rights in our services, including but not limited to school photography, Group Class Photos, Individual Portrait sessions, and other related school photography services (the "Services"), as well as all material published on our Platform and in our marketing materials. These works are protected by copyright laws and treaties worldwide, and all such rights are reserved. No copyright is transferred to the Client upon booking a Session or purchasing a package.

Purchase of a package grants the Client a limited, non-exclusive, non-transferable licence to reproduce and use the purchased images for personal, non-commercial purposes only, including personal display, family sharing, and personal social media use. The Client must not reproduce, distribute, sell, sublicense, or otherwise use the images for any commercial purpose, and must not submit the images to a third-party printing or reproduction service that requires a copyright release, without our prior written consent. The Client must not alter, edit, or digitally manipulate the images in any manner that misrepresents our original work.

You may print one copy, and may download extracts, of any page from our Platform for your own personal use. You must not modify any material you have printed or downloaded in any way, and you must not use any images, illustrations, video, or graphics from our Platform separately from any accompanying text. Our status as the author of content on our Platform must always be acknowledged.

Unless otherwise agreed with you in writing, you must not use any part of the content on our Platform for commercial purposes without first obtaining permission from us. If you print, copy, or download any part of our Platform in breach of these Terms, your right to use our Services and Platform will cease immediately, and you must, at our option, return or destroy any copies of the material you have made.

Where we hold registered trademarks, you are not permitted to use them without our approval. Use of our trademarks or associated logos without our express prior written permission is not permitted.

Our right to use Session images for our own portfolio, marketing, and promotional purposes is addressed separately under Image Usage and Marketing Consent, below.

Full payment is required at the time of booking. A Session is not confirmed, and no place is reserved, until payment has been received and processed in full.

Each Session date is subject to a Booking Cutoff, as displayed on the Platform. No bookings, amendments, or cancellations will be accepted after the applicable Booking Cutoff has passed.

A request to reschedule a Session must be submitted no later than 24 hours prior to the scheduled Session time, and is subject to the availability of alternative slots.

Each booking is entitled to one complimentary reschedule. A fee of $15 applies to each subsequent reschedule request.

We do not guarantee the availability of alternative slots. Where no suitable slot remains on the available Session dates for the relevant School campus, a reschedule cannot be offered.

The Client is responsible for ensuring the child arrives no later than 15 minutes prior to the scheduled Session time.

Where a child arrives after their allocated slot has concluded, no refund will be issued. We may, at our sole discretion, offer a reschedule subject to availability.

Cancellations received more than 24 hours prior to the scheduled Session are eligible for a refund of the amount paid, less a $10 processing fee.

Cancellations received within 24 hours of the scheduled Session are non-refundable. At our sole discretion, such cancellations may instead be converted to a reschedule, subject to availability.

Failure to attend a Session without prior cancellation (a "no-show") is non-refundable and non-reschedulable.

Group Class Photos are scheduled directly by the School. Once a Group Class Photo has been taken, it is non-refundable, save where we determine, at our sole discretion, that photographer error has occurred or that the resulting images are unusable, in which case a reshoot or refund will be offered.

Approved refunds will be processed to the original payment method within 5 to 10 business days.

This section is supplementary to, and should be read alongside, our separate Refund and Cancellation Policy, which forms part of these Terms.

Post-production editing is limited to standard colour correction, lighting adjustment, and cropping.

We do not provide digital compositing services, including the insertion, removal, or substitution of a child into or from an image (for example, to represent a child who was late or absent on the Session date). It remains the Client's responsibility to ensure the child is present and punctual for the scheduled Session.

By booking a Session, the Client acknowledges and agrees that images of their child taken during a Group Class Photo or Individual Portrait Session may be used by us for promotional and marketing purposes, including but not limited to our website, social media, and print portfolio.

We will not publish a child's full name or personal or contact details alongside any image.

If the Client does not wish for their child's image to be used for marketing purposes, they must notify us in writing prior to the Session date. The child's photographs will still be taken and delivered as normal; this only affects external marketing use.

JP Photography holds a current Working with Children Check ("WWCC"), in accordance with the requirements of NSW legislation governing child-related work.

Verification of the WWCC is available to the School upon request.

Personal information collected during the booking process — including the name, contact details, class, and campus of the parent/guardian and child — is collected and used solely for the purpose of scheduling, delivering, and invoicing the Session, and is not disclosed to any third party except where necessary to process the booking.

Payment is processed by Stripe, a third-party payment processor. We do not access or retain full payment card details.

Digital images and associated booking records are retained for a period of 12 months from the Session date, after which they may be permanently deleted. A Client may request earlier deletion of their data at any time by emailing pedrosoportraits@gmail.com.

Images are stored on password-protected, encrypted cloud storage accessible solely to us.

Where we provide you with a personal identification number ("PIN") to access your child's images via our online gallery, that PIN is personal to you and must not be shared with any other person.

If you share your PIN with a third party, that person will have access to the associated images. We will not be liable to you if you share your PIN with a third party, or otherwise allow access to the personal information associated with that PIN.

The five images included in each package are selected by us with the intention of representing a range of poses and styles (for example, smiling, full-body, close-up, and candid). Substitution of the five included images is not available.

Additional images beyond the five included in a package may be made available for separate purchase, at our discretion. We do not guarantee the availability or number of such additional images in advance, as this depends on the number of usable images obtained during each child's Session, which varies according to the 15-minute time allocation and the child's cooperation on the day.

Digital images will be delivered via email, download link, or online gallery within 4 to 6 weeks of the Session date.

Printed images, where included in the Client's package, will be delivered via the School within 4 to 6 weeks of the Session date.

We shall not be liable for any delay to, or failure of, a Session arising from circumstances beyond our reasonable control, including but not limited to School closures, extreme weather, or illness. In such circumstances, the affected Session will be rescheduled at no additional cost to the Client.

We reserve the right to modify, change, add to, or remove portions of these Terms at any time. Please check these Terms regularly prior to using our Platform, to ensure you are aware of any changes and of the Terms then in effect, which may differ from the version you previously accepted. We will endeavour to highlight any significant or substantive changes to you where possible, but do not undertake to do so, and any failure by us to do so will not affect the enforceability of the Terms then in effect. If you choose to use our Platform, we will regard that use as conclusive evidence of your agreement to, and acceptance of, the Terms then governing your and JP Photography's rights and obligations to one another.

These Terms are governed by the laws of New South Wales, Australia, and the parties submit to the non-exclusive jurisdiction of its courts.
